Terms of Service

These Terms of Service (“Terms”) govern access to and use of occupier.lol (the “Service”), including the public 100×100 board, leaderboard, checkout, holds, and related features. By using the Service, creating a listing, or completing a payment, you agree to these Terms, the Rules, and the Privacy Policy.
If you do not agree, do not use the Service and do not pay for cells.
Operator and contact
The Service is operated from Australia (“we”, “us”, “our”). The Service is provided from https://occupier.lol.
Legal and listing notices: a contact email will be posted on this page when one is ready. That address will be the one inbox for legal notices, privacy, listings, and all other contact.
These Terms work together with the public Rules. If the Rules and these Terms conflict, these Terms control.
What the Service is
occupier.lol is a paid public billboard. You may pay to stamp an image and a website URL onto cells. Listings are paid advertisements, not editorial reviews, certifications, endorsements, or independent rankings.
A payment buys the cells you checkout at the prices shown, until someone else pays the next 1.5× price (or you lose them another way allowed by these Terms). It does not buy traffic, clicks, customers, revenue, exclusive placement, a fixed time on those cells, search-engine ranking, or any particular result. Someone else can pay more and take the lot. The sidebar leaderboard ranks spend and current value; it is not the ad. Category rankings use the same formulas. We assign a category automatically; a move is by email once a contact address is posted. We may change, pause, or discontinue features, including prices, holds, add-value, categories, and ranking formulas.
Eligibility
- You must be at least 18 years old and able to form a binding contract.
- If you use the Service for a company, you represent that you have authority to bind that company, and “you” includes that company.
- You may not use the Service if you are prohibited from receiving services under applicable law, including Australian sanctions and other trade sanctions.
Payments, Stripe, and taxes
Card checkout is processed by Stripe when Stripe keys are configured. We do not collect or store full payment-card numbers. Stripe’s terms and privacy notice also apply to the payment itself. Amounts are priced in US dollars. Applicable taxes may be added at checkout. When Stripe is not configured, checkout may be simulated so the board can still run; simulated payments do not charge a card.
Cell prices, the $0.50 checkout floor after launch, the $1 any-size launch until 80% of the board is claimed, claimed-only takeovers during launch at 1.5× listed prices, mixed lots at $1 plus those listed prices, 1.5× takeovers after launch, add-value minimums, and hold timers are described in the Rules and shown before you pay. Completing checkout is an offer to buy those cells on those terms. Ownership is assigned when payment is confirmed and the listing is written to the board.
No refunds
All payments are final and not refundable. Buying cells is a digital service that begins as soon as payment is confirmed: the listing is stamped, prices jump, and the paid amount is counted on the public board. Being taken over later, a drop on the 24-hour leaderboard, fewer clicks than you hoped for, downtime, or a later removal for breach of these Terms does not create a refund.
By completing checkout you request that we start this digital service immediately. Nothing in these Terms excludes a right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where the ACL requires a refund or other remedy, we provide that remedy. Chargebacks, payment disputes, or reversed payments without a legally required basis are a breach of these Terms; we may wipe the listing and refuse future use of the Service.
Listings
You identify with a website URL. No password. You may only list a URL that you own or are authorized to represent. Returning with the same URL locks title, photo, and description; only the price can change. App Store, Play Store, GitHub, and similar platform links are keyed by path. Tracking query strings are ignored. Shorteners are expanded to the destination URL.
You must have the right to send visitors to that destination. Fake, impersonating, or unauthorized listings are grounds for removal without refund.
Your warranties
By submitting a URL, image, or payment, you represent and warrant that:
- You have the right to list that destination and to send visitors there.
- The listing and destination comply with applicable laws, including advertising, consumer, privacy, intellectual-property, and regulated-industry rules.
- You are not impersonating another person, brand, or company, and you are not stamping a competitor’s site without authorization.
- The destination is not malware, phishing, a scam, or a site whose primary purpose is to deceive visitors.
- The information you submit is accurate, and you will keep it accurate.
Prohibited listings and use
In addition to the Rules, you may not list or use the Service for:
- Sexual, pornographic, or adult-platform content; chat, invite, or messaging-group links (Telegram, WhatsApp, Discord, Messenger, Signal, and similar); or link shorteners used to hide the real destination.
- Content that is illegal, fraudulent, defamatory, harassing, hateful, violent, or that exploits children.
- Counterfeit goods, unauthorized streaming, or other infringement of copyright, trademark, or other rights.
- Offers that require licenses you do not have (including certain financial, medical, gambling, or weapons-related offers).
- Camping checkout holds to freeze lots you do not intend to buy, cycling abandoned checkouts to block others, or otherwise abusing holds.
- Interfering with the Service: scraping beyond ordinary browsing, manipulating click counts, bypassing rate limits, automated bidding without our written permission, or reverse engineering except as allowed by mandatory law.
Our right to remove listings
We may refuse, delay, hide, or permanently remove any listing, bid, hold, or related data, with or without notice, including where we believe these Terms, the Rules, or the law may have been broken; where a rights holder complains; or where we think the listing creates legal, security, or reputational risk. If we catch hold abuse, we may wipe your cells and drop you from the leaderboard. Removal does not entitle you to a refund.
Fair use and third-party content
To run the board we display what you submit and what we need to identify a listing: titles, descriptions, images, logos, and destination URLs. We use that material to show visitors where a paid lot leads and to operate, moderate, and improve the Service.
That display is intended only to identify the listed destination. We do not use it as our own brand, and we do not suggest sponsorship or endorsement by the rights holder unless you are that rights holder.
occupier.lol, the wordmark, and the look of the Service are ours. You may not copy the Service, scrape the board for a competing billboard, or use our brand in a way that suggests we endorse you. Stripe and other third-party names remain their owners’ property.
License you grant us
You grant us a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, adapt (for cropping, slicing onto cells, and ranking display), and publicly display the listing, images, and public metadata, for as long as needed to operate, promote, and keep an archive of the Service. You also grant visitors a right to see that listing on the Service. If you want a listing taken down, use the contact email posted on this page. Takedown does not undo a completed payment.
Complaints and rights notices
If you believe a listing infringes your copyright, trademark, publicity, or other rights, or that a listed site is unlawful, send a notice to the contact email posted on this page with: (1) your name and contact details; (2) where the lot sits on occupier.lol; (3) the destination URL; (4) a description of the problem; and (5) a statement that the notice is accurate and that you are the rights holder or authorized to act. We may remove or restrict the listing while we review the notice. We may share the notice with the lister. Repeat or abusive notices may be ignored.
No endorsement, no earnings claims
Appearance on the board is not our opinion of a product. We do not verify that listed companies, claims, prices, or results are true. Click counts describe what our systems recorded; they are not a promise that you will get the same outcome. Your results depend on your bid, your destination, timing, and factors we do not control.
Links from the Service to listed sites leave occupier.lol. Those destinations have their own terms and practices. We are not responsible for them.
Availability and changes
We provide the Service as-is. It may be unavailable, slow, or incorrect. We may change prices, hold rules, or these Terms. If a change is material, we will update the date at the top of this page. Continued use after a change means you accept the new Terms. For a payment already completed, the Terms in effect at checkout still apply to that payment, except where a change is required by law or needed to address a security or legal risk.
Disclaimers
To the fullest extent permitted by law, and subject to the Australian Consumer Law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that listings, names, images, ranks, or click counts are accurate or complete.
Limitation of liability
Nothing in these Terms limits liability that Australian law says we cannot limit, including liability under the Australian Consumer Law, or for fraud, or for injury to life, body, or health. Subject to that:
- We are not liable for lost profits, lost data, lost goodwill, substitute services, or other indirect, incidental, special, or consequential damages.
- Our total liability for a claim relating to a payment is limited to the amount you paid us for the listing that the claim concerns in the three months before the claim.
Indemnity
You will defend, indemnify, and hold harmless the operator of occupier.lol and people working on the Service from claims, damages, losses, and reasonable legal fees arising out of your listing, your destination site, your payment or chargeback, your breach of these Terms, or your infringement of someone else’s rights. We may take over the defense of a claim; you will cooperate.
Governing law
These Terms are governed by the laws of Australia, excluding conflict-of-law rules. If you are a consumer, the Australian Consumer Law still applies. If you are not a consumer, the courts of Australia have exclusive jurisdiction, to the extent permitted.
General
- If a part of these Terms is unenforceable, the rest remains in effect, and the invalid part is replaced by the valid term that comes closest to the original intent.
- Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
- These Terms, the Rules, the Privacy Policy, and the checkout details you confirm form the entire agreement for the Service.
- Payments and hosting may involve third parties, including Stripe and Vercel. Their outages or decisions are outside our control.
